Last updated: September 8, 2026These Terms of Service govern your use of www.gulfcoastsmokeshop.com and any purchase you make from Gulf Coast Smoke Shop, located at 3465 Bonita Beach Rd SW #6, Bonita Springs, FL 34134. By using this website or placing an order, you agree to these terms. If you do not agree, please do not use this website.
Throughout these terms, "we," "us," "our" and "Gulf Coast Smoke Shop" refer to the business. "You" refers to the person using the website or placing an order.
Age Requirement
Federal law and Florida law require purchasers of tobacco, nicotine and hemp-derived products to be at least 21 years of age. By using this website you represent that you are 21 or older.
We verify age in the following ways:
- An age confirmation prompt when you enter the website;
- A valid government-issued photo ID at the time of in-store pickup;
- A valid government-issued photo ID, matching the name on the order, at the time of local delivery.
We reserve the right to refuse or cancel any order that cannot be age verified, and to refuse service to anyone at our discretion. Providing false information about your age is a violation of these terms.
Products We Sell
Gulf Coast Smoke Shop sells nicotine vaping products, hemp-derived products, kratom, cigars, glass, rolling supplies and accessories. Product availability, pricing and selection vary and may change without notice.
Product images on this website are for illustration. Packaging, labeling and formulation may differ from the images shown. We rely on manufacturer information for product descriptions and cannot guarantee that every detail is complete or current.
Nicotine Products
Nicotine products sold on this website are intended for adults 21 and older. They are not intended for use by anyone who is pregnant or breastfeeding, anyone with a heart condition or other medical condition, or anyone who does not already use nicotine.
Hemp-Derived Products
Hemp-derived products sold by Gulf Coast Smoke Shop contain no more than 0.3% delta-9 THC on a dry weight basis, consistent with the federal Agriculture Improvement Act of 2018 and applicable Florida law.
These products have not been evaluated by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure or prevent any disease. Consult a physician before use, particularly if you are pregnant, breastfeeding, taking medication or have a medical condition.
Hemp-derived products may cause impairment. Do not drive or operate machinery after use. Use of these products may result in a positive drug test. You are responsible for understanding the laws that apply where you live and where the product will be used.
Kratom
Kratom products are sold only to customers 21 and older. Kratom has not been evaluated by the U.S. Food and Drug Administration and is not intended to diagnose, treat, cure or prevent any disease.
Kratom is not legal in every state, county or municipality. You are responsible for confirming that kratom is legal where you live before purchasing. Consult a physician before use.
Orders and Pricing
Placing an order is an offer to purchase. We may accept or decline any order for any reason, including product availability, pricing errors, suspected fraud, or an inability to verify your age.
We make every effort to display accurate pricing. If a product is listed at an incorrect price, we reserve the right to cancel the order and issue a full refund, whether or not the order has been confirmed.
Prices are shown in U.S. dollars and do not include applicable Florida sales tax, which is calculated at checkout.
Payment
Payment is processed through our third-party payment processor. We do not store complete payment card information on our servers. By submitting payment information you represent that you are authorized to use the payment method provided.
Pickup and Local Delivery
Orders are fulfilled by in-store pickup or local delivery within our service area. We do not ship nicotine or hemp-derived products by mail.
In-store pickup. Orders are held for pickup at 3465 Bonita Beach Rd SW #6, Bonita Springs, FL 34134. Bring a valid government-issued photo ID. Orders not collected within seven days may be cancelled and refunded.
Local delivery. Delivery is available within our published service area. An adult 21 or older must be present to receive the order and must present a valid government-issued photo ID matching the order. If no one is available to accept and verify, the order will be returned to the store and a redelivery or restocking fee may apply.
Delivery times are estimates and are not guaranteed.
Returns
Because of the nature of the products we sell, most items are final sale. Full details are on our Pickup & Returns page, which forms part of these terms.
Defective or damaged items must be reported within 48 hours of pickup or delivery. Manufacturer warranties, where they exist, are administered by the manufacturer.
VIP Club
VIP Club membership is billed monthly at the rate shown at the time of signup and continues until cancelled. Membership benefits are subject to change. Membership is non-transferable and available only to customers 21 and older. Cancellation takes effect at the end of the current billing period; membership fees already paid are not refunded.
Acceptable Use
You agree not to use this website to:
- Purchase products on behalf of anyone under 21;
- Resell products purchased from us without our written permission;
- Provide false, inaccurate or misleading information;
- Interfere with, disrupt or attempt to gain unauthorized access to the website or its systems;
- Violate any applicable federal, state or local law.
Intellectual Property
The Gulf Coast Smoke Shop name, logo, website design, photography and written content are our property or are used with permission. You may not copy, reproduce or use them without our written consent. Product names and manufacturer trademarks belong to their respective owners.
Disclaimer of Warranties
This website and the products sold through it are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
We do not warrant that the website will be uninterrupted, error-free or free of harmful components.
Limitation of Liability
To the fullest extent permitted by Florida law, Gulf Coast Smoke Shop and its owners, employees and agents will not be liable for any indirect, incidental, special or consequential damages arising from your use of this website or any product purchased from us.
Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
Nothing in these terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Gulf Coast Smoke Shop from any claim or demand, including reasonable attorneys' fees, arising from your breach of these terms, your misuse of any product, or your violation of any law or the rights of a third party.
Privacy
Our Privacy Policy describes how we collect and use your information and forms part of these terms. If you have opted into text messages from us, our SMS Policy also applies.
Governing Law
These terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these terms or from a purchase will be brought in the state or federal courts located in Lee County, Florida, and you consent to the jurisdiction of those courts.
Changes to These Terms
We may update these terms at any time. Changes take effect when posted to this page, and the "last updated" date above will reflect the revision. Your continued use of the website after changes are posted constitutes acceptance of the revised terms.
Severability
If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.
